Jury recommends 60 years in prison
A nine man, three woman jury deliberated for just over two hours on Thursday before convicting Mardieth Neil Farrell of Antlers of all three felony charges which he faced and recommending that he serve sixty years in Prison. Farrell was charged with Sexual Assault of a Child, Showing Pornography to a Child and Physical Abuse of a Child.
The trial which was scheduled to begin Monday was delayed until Tuesday due to a gas leak that evacuated the courthouse. At the trial, the State was represented by Johnny S. Loard, First Assistant District Attorney and Mark Uptegrove, Assistant District Attorney assigned to Pushmataha County. Farrell was represented by Allen Malone of Idabel.
During the three day trial, the State called thirteen witnesses, among them, the victim, three children who witnessed the physical abuse, a Sexual Assault Nurse, an agent with the OSBI who conducted the forensic interview of the children, an expert on Sexual Assault and Domestic Violence and Sonny Stewart, the OSBI case agent.
Also allowed to testify was a woman who lives out of state who testified how the defendant had raped her in a very similar manner when she was 12 years old and was babysitting the victim in this case who was then a newborn.
The defense called numerous witnesses, including Farrell's father, mother, brother and son. Farrell also testified on his own behalf and on an interesting note admitted on cross examination that he had twice appeared on the Jerry Springer Show.
First Assistant District Attorney, Johnny S. Loard, commended the agents with the Oklahoma State Bureau of Investigation, for the thorough investigation. â€śIn over fifteen years of prosecuting cases, this may be the most monstrous set of facts I've ever seen. Without the courage of the victim to tell her story and the tireless efforts of the OSBI agents, convictions in this case would not have been possible.â€ť
District Attorney Mark Matloff stated he was extremely happy with the Jury's decision. â€śThis verdict shows that the public will not tolerate sexual predators and those who abuse children. This Office remains determined to punishing those who commit these vile acts.â€ť
