Witness attacked after testifying in court

Pushmataha County Deputy Shawn Culver was called to the Pushmataha County Hospital on behalf of a victim who had been assaulted shortly after he testified in court.

Upon arrival, Deputy Culver identified the victim as Danny Dixon. Dixon told Deputy Culver that he was getting into his vehicle to leave a friends house, that is located behind the Clayton Police Department, when he saw a tan Silverado pull up. Dixon said that Brian Schumann, a 49 year old white male from Clayton, got out of the passenger seat and walked towards him and said that they needed to talk since Dixon didn’t have a protective order against him anymore.

Dixon stated that he then told Schumann that he never did have a protective order against him.

Dixon said that Schumann then said that he was going to “kick his ...” and they got into a fight. Dixon said that Schumann hit him, from what he could remember, two times in the face with is fist. Dixon stated that Schumann said that he was going to kill him and then stopped hitting him, got in his vehicle and left.

Dixon then told the Deputy that he did testify that day at court on the protective order Dale Jackson had against Schumann. Dixon had testified on behalf of Jackson.

Deputy S. Culver was also informed that the Clayton Police Department had be contacted on the night of the fight and asked Lela what she had seen. Lela asked them if she needed to fill out a statement and they told her no, not unless the victim is filling charges.

Schumann is being charged with Aggrevated assault and battery, Assault and battery on a witness, and disturbing the peace. A warrant was issued for his arrest on June 3, 2013. His initial court date is scheduled for Wednesday, July 10, 2013.
