Oklahoma Highway Patrol Trooper Tommy Allen stopped a white pickup on Highway 3 near cloudy road for driving on the middle line of t he roadway. After the vehicle was stopped, the driver was identified as Jennifer Bailey, 30 year old female of Rattan.
Allen asked Bailey for her driverâ€™s license and she stated that she didnâ€™t have it with her. Allen noticed that there were four rifles inside the vehicle and asked Bailey if they were loaded. She responded yes. In the back seat of the vehicle there were two small children who were sleeping and Morgan Bailey, 31 year old male of Rattan, was sitting in the passenger seat.
While talking to Jennifer, Allen stated in his report that he detected an odor of an alcoholic beverage. He then asked Jennifer if she had been drinking and she responded yes. In the back of the pickup Allen noticed six deer which had already been cut up. Allen then asked Jennifer if she had checked the deer in. She said not yet. Wildlife Officer Eric Barnes was then called to the traffic stop.
Allen then checked Jenniferâ€™s eyes for HGN and she failed 4 of the 6 clues. He then asked her if she would take a portable breath test and she did so. She tested .16 on the PBT. Allen then placed her under arrest and read the implied consent. Jennifer never would say if she would consent to take the state test or not so Allen filled out a refusal form at the County Jail.
Assisting Allen on the traffic stop was Deputy James Marzek. After Marzek was told that the driver was arrested and taken to jail he went to the passenger side of the vehicle and could see that Morganâ€™s eyes were blood shot and he had a strong odor of an intoxicating beverage about him. Marzek told Morgan to exit the vehicle because he was under arrest for Public Intoxication and Morgan refused. Marzek and Allen then assisted Morgan out of the vehicle after a brief struggle. Morgan was taken to the ground and placed into wrist restraints. Marzek then placed Morgan into the back of his unit for transport to the Pushmataha County jail where he was booked.
Jenniferâ€™s parents came to the scene to pick up the children and the vehicle.
Jennifer Bailey is being charged with Driving under the influence of alcohol and Transporting loaded firearms in a motor vehicle. Morgan Bailey is being charged with Resisting arrest and Public Intoxication. Neither are being charged with Child Endangerment at this time.
